Please read these Terms carefully before using our services. By accessing, browsing, purchasing, selling, bidding, or otherwise using Macabre.rip, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you do not agree to these Terms, you must not access or use our marketplace or services.

Acceptance of Terms

By visiting, browsing, creating an account, purchasing products, participating in auctions, listing items for sale, communicating with vendors, or otherwise using any part of the Macabre.rip marketplace and services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use, as well as our Privacy Policy, which is incorporated herein by reference.

Your continued use of Macabre.rip following the posting of any updates or modifications to these Terms constitutes acceptance of those changes. If you use our services on behalf of a business, brand, vendor, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms.

Important: These Terms include limitations of liability, dispute resolution provisions, and governing law terms that affect your legal rights. Please review all sections carefully before using the Macabre.rip marketplace and services.

About Our Service

Macabre.rip operates as an online marketplace and auction platform connecting buyers, collectors, artists, vendors, creators, and small businesses from around the world through a shared appreciation for the macabre, gothic, horror, occult, and alternative arts. We provide a platform for users to discover, buy, sell, auction, and showcase products, collectibles, artwork, fashion, curiosities, décor, and other darkly inspired goods.

Marketplace Listings

Browse and discover products, shops, creators, collectors, artists, and vendors across a wide range of macabre and alternative categories.

Auctions & Bidding

Participate in live and timed auctions for rare collectibles, handmade creations, horror memorabilia, oddities, antiques, artwork, and one-of-a-kind items.

Vendor Shops

Create and manage vendor storefronts to sell products, showcase collections, connect with customers, and grow within the alternative marketplace community.

Marketplace Resources

Access curated content, featured creators, community highlights, guides, and marketplace updates related to gothic, horror, occult, and underground culture.

Global Discovery

Connect with independent vendors, artists, collectors, and small businesses from around the world through a centralized dark marketplace experience.

Community & Creator Promotion

Highlight emerging artists, underground brands, collectors, and independent creators through featured listings, curated showcases, promotional opportunities, and community-driven discovery across the marketplace.

Macabre.rip acts solely as a marketplace intermediary and platform provider. Any transaction, agreement, purchase, sale, auction, shipment, or dispute regarding products or services is strictly between the buyer and the vendor, seller, or auctioneer involved. We do not manufacture, own, authenticate, inspect, guarantee, or directly sell the products listed by third-party vendors unless explicitly stated otherwise.

Eligibility

To access or use Macabre.rip, you must meet all of the following requirements:

Age: You must be at least 18 years of age to create an account, purchase products, participate in auctions, sell items, or otherwise use the marketplace.

Legal Capacity: You must possess the legal authority and capacity to enter into binding agreements under applicable laws and regulations.

Geographic Availability: Macabre.rip is accessible internationally; however, certain products, services, auctions, or vendor listings may be restricted based on your location and applicable laws.

Compliance with Laws: You may not use the marketplace if you are prohibited from receiving services under the laws of the United States or any other applicable jurisdiction. Users are responsible for ensuring that their use of the platform complies with all local, state, federal, and international laws.

Vendor & Business Authority: If you create an account, list products, or use the marketplace on behalf of a business, organization, brand, or vendor entity, you represent and warrant that you have the authority to bind that entity to these Terms.

Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account.

We reserve the right to refuse service, suspend or terminate accounts, remove listings, cancel auctions, or restrict access to the marketplace at our sole discretion if we reasonably believe these eligibility requirements or marketplace policies have been violated.

User Accounts

Certain features of the Macabre.rip marketplace may require you to create an account. By registering for an account, you agree to provide accurate, current, and complete information and to keep your account details updated as necessary.

Account Responsibilities

Account Credentials: You are solely responsible for maintaining the confidentiality and security of your password, login credentials, and account information.

Unauthorized Access: You must notify us immediately if you suspect unauthorized access to your account, security breaches, fraudulent activity, or any unauthorized use of your credentials.

Account Activity: You are responsible for all activity that occurs under your account, whether You are fully responsible for all activity conducted through your account, whether performed by you or by another party using your credentials.

Accurate Information: You agree not to provide false, misleading, or impersonated identity information when creating or maintaining an account on Macabre.rip.

One Account Policy: You may not create multiple accounts for the same individual, business, vendor, or entity without our prior written permission.

Vendor Responsibilities: Vendors, sellers, artists, and auctioneers are responsible for ensuring that all listings, descriptions, pricing, images, and communications posted through their accounts are accurate and comply with marketplace policies and applicable laws.

We reserve the right to suspend, restrict, terminate, or remove accounts, listings, auctions, or marketplace access at our sole discretion if we detect suspicious behavior, fraudulent activity, violations of these Terms, abuse of the platform, or other conduct deemed harmful to Macabre.rip or its community.

Permitted Use

Subject to these Terms, Macabre.rip grants you a limited, non-exclusive, non-transferable, revocable license to access and use the marketplace and its services for lawful personal, commercial, and community-related purposes, including:

Browsing and discovering products, collectibles, artwork, fashion, curiosities, auctions, and vendor storefronts

Purchasing, bidding on, selling, or listing eligible products and services through the marketplace

Creating vendor shops, managing listings, and promoting products or collections

Reading, viewing, and downloading marketplace content for personal, non-commercial informational use

Communicating with vendors, buyers, collectors, artists, and other marketplace users regarding legitimate transactions or inquiries

Posting honest, lawful, and factual reviews, ratings, comments, and marketplace feedback

This license is granted solely for legitimate use of the Macabre.rip platform. Unauthorized commercial exploitation of marketplace data, automated scraping, copying of listings, mass data harvesting, unauthorized resale of content, fraudulent activity, or the use of bots, crawlers, or automated systems without our prior written consent is strictly prohibited.

Prohibited Conduct

The following activities are strictly prohibited on Macabre.rip. Violations may result in immediate account suspension or termination, removal of listings or auctions, legal action, or other enforcement measures at our sole discretion:

Posting false, fraudulent, misleading, stolen, or deceptive listings, bids, reviews, products, or account information

Selling prohibited, illegal, counterfeit, stolen, or unauthorized items through the marketplace

Scraping, harvesting, copying, or bulk-downloading marketplace data, listings, images, vendor information, or user content without authorization

Using bots, scripts, crawlers, AI automation, or other automated systems to access, manipulate, or interfere with the platform

Impersonating any person, vendor, artist, collector, business, or entity, or falsely representing affiliations or identities

Attempting to gain unauthorized access to accounts, servers, payment systems, databases, or other parts of the marketplace infrastructure

Uploading or transmitting malware, ransomware, spyware, viruses, malicious code, or harmful content of any kind

Manipulating auctions, shill bidding, price fixing, fake transactions, or engaging in fraudulent marketplace activity

Posting unlawful, abusive, defamatory, threatening, hateful, obscene, or infringing content

Using Macabre.rip for unauthorized commercial exploitation, competitive intelligence, or activities intended to harm the platform, its vendors, or its community

We reserve the right to investigate suspected violations and cooperate with law enforcement or regulatory authorities when necessary.

Vendor Listings & Marketplace Accuracy

We strive to maintain accurate, current, and reliable listings throughout the Macabre.rip marketplace. However, we do not guarantee the completeness, accuracy, authenticity, legality, availability, condition, or reliability of any product, listing, vendor profile, auction, description, image, or marketplace content.

Vendors, sellers, artists, collectors, and auctioneers featured on Macabre.rip are independent third parties operating their own businesses or personal storefronts. Inclusion on the marketplace does not constitute endorsement, recommendation, authentication, certification, warranty, or guarantee by Macabre.rip regarding the quality, legality, safety, originality, authenticity, shipping practices, licensing, or conduct of any seller or product.

Buyers are strongly encouraged to independently evaluate vendors, review product descriptions carefully, request additional information when necessary, and exercise appropriate caution before making purchases, placing bids, or entering into transactions.

Always verify product details, authenticity claims, dimensions, materials, condition, shipping terms, and seller information independently before completing any transaction or submitting payment.

We reserve the right to remove, suspend, restrict, edit, or modify any listing, vendor account, auction, review, or marketplace content at any time, including where we reasonably believe a seller has violated marketplace policies, received credible complaints, engaged in fraudulent conduct, infringed intellectual property rights, or listed prohibited or misleading items.

Purchases, Inquiries & Marketplace Transactions

When you place an order, submit an inquiry, participate in an auction, contact a vendor, or otherwise engage in transactions through Macabre.rip, you authorize us to share the information necessary to facilitate that interaction with the relevant vendor, seller, artist, collector, or auctioneer involved in the transaction.

What You Agree To When Using the Marketplace

Accurate Information: You agree that all information you provide, including account details, shipping information, payment details, bids, and communications, is truthful, accurate, and submitted in good faith.

Vendor Communication: You consent to receiving communications from vendors, sellers, auctioneers, and Macabre.rip regarding orders, bids, inquiries, account activity, shipping updates, customer support, and marketplace-related matters through email, phone, text message, or platform messaging systems where applicable.

No Guarantee: Macabre.rip does not guarantee product availability, auction outcomes, pricing, authenticity, delivery times, vendor responsiveness, or the successful completion of any transaction or purchase.

Independent Transactions: Any purchase, bid, sale, shipment, agreement, refund, dispute, or transaction conducted through the marketplace is solely between the buyer and the vendor, seller, artist, collector, or auctioneer involved. Macabre.rip is not a party to those agreements or transactions unless explicitly stated otherwise.

Auction Responsibility: By placing bids in auctions, you acknowledge that bids may be binding and that you are responsible for completing purchases in accordance with the seller’s auction terms and applicable laws.

Duplicate or Fraudulent Activity: We reserve the right to cancel, restrict, suspend, or remove transactions, bids, listings, or accounts that appear fraudulent, abusive, duplicated, manipulative, or in violation of these Terms or marketplace policies.

Intellectual Property

All content available on Macabre.rip — including but not limited to text, graphics, logos, artwork, icons, images, photographs, videos, audio, product listings, marketplace designs, software, code, data compilations, branding elements, and the overall appearance, structure, and functionality of the platform — is owned by Macabre LLC, its licensors, vendors, artists, or content providers and is protected by United States and international intellectual property, copyright, trademark, and related laws.

You may not reproduce, distribute, modify, republish, scrape, copy, create derivative works from, publicly display, commercially exploit, or otherwise use any portion of the Macabre.rip platform or its content without prior written permission from the applicable rights holder.

The Macabre.rip name, logos, branding, marketplace identity, and related marks are trademarks or protected property of Macabre LLC. Unauthorized use of these marks is strictly prohibited.

User-Submitted Content
By submitting content to Macabre.rip — including but not limited to product listings, reviews, comments, photographs, artwork, descriptions, messages, vendor content, or other materials — you represent that you own or have the necessary rights to submit such content. You grant Macabre.rip a worldwide, non-exclusive, royalty-free, transferable, sublicensable, and perpetual license to use, reproduce, display, distribute, promote, modify, and publish that content in connection with operating, marketing, and improving the marketplace and its services.

You retain ownership of your original content; however, you acknowledge that content submitted publicly to the marketplace may be viewable, shared, or indexed by third parties and search engines.

Disclaimers

THE MACABRE.RIP MARKETPLACE, PLATFORM, AUCTIONS, CONTENT, LISTINGS, PRODUCTS, SERVICES, AND ALL RELATED MATERIALS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MACABRE LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AUTHENTICITY, ACCURACY, AVAILABILITY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

No Vendor or Product Warranty: Macabre.rip makes no representations or guarantees regarding the authenticity, legality, quality, condition, safety, originality, reliability, or accuracy of any product, listing, auction, vendor, artist, collector, or seller featured on the marketplace.

No Transaction Guarantee: We do not guarantee the successful completion of any purchase, sale, bid, auction, shipment, refund, or transaction conducted through the platform.

No Pricing or Availability Guarantee: Prices, bids, listings, inventory, shipping estimates, and product availability displayed on the marketplace may change at any time without notice and are not guaranteed until a transaction is finalized by the applicable seller.

Third-Party Content & Links: The marketplace may contain links to third-party websites, social platforms, payment processors, or external services provided for convenience only. Marketplace Role: Macabre.rip operates solely as an intermediary platform connecting independent buyers and sellers. Except where explicitly stated otherwise, we are not the seller, manufacturer, authenticator, shipper, or owner of items listed by third-party vendors on the marketplace.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MACABRE LLC, MACABRE.RIP, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, OWNERS, EMPLOYEES, AFFILIATES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE MACABRE.RIP MARKETPLACE, SERVICES, AUCTIONS, CONTENT, PRODUCTS, OR PLATFORM.

THIS LIMITATION INCLUDES, WITHOUT LIMITATION, DAMAGES RELATED TO LOST PROFITS, LOST REVENUE, LOST BUSINESS OPPORTUNITIES, LOST DATA, ACCOUNT ACCESS ISSUES, REPUTATIONAL HARM, BUSINESS INTERRUPTION, TRANSACTION DISPUTES, SHIPPING ISSUES, PRODUCT DEFECTS, PERSONAL INJURY, PROPERTY DAMAGE, OR UNAUTHORIZED ACCESS — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

MACABRE.RIP IS A PLATFORM THAT FACILITATES INTERACTIONS BETWEEN INDEPENDENT BUYERS AND SELLERS. WE ARE NOT RESPONSIBLE FOR THE ACTIONS, PRODUCTS, CONDUCT, STATEMENTS, LISTINGS, TRANSACTIONS, SHIPPING PRACTICES, OR FAILURES OF ANY THIRD-PARTY VENDOR, SELLER, BUYER, ARTIST, COLLECTOR, OR AUCTIONEER USING THE MARKETPLACE.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS, THE MARKETPLACE, OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (USD $100) OR (B) THE TOTAL FEES PAID BY YOU DIRECTLY TO MACABRE LLC, IF ANY, DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not permit the exclusion or limitation of certain warranties, liabilities, incidental damages, or consequential damages. If the laws of your jurisdiction apply, some of the limitations or exclusions contained within these Terms may not apply to you, and you may have additional rights under applicable law.

Indemnification

You agree to defend, indemnify, and hold harmless Macabre LLC, Macabre.rip, and their affiliates, owners, officers, directors, employees, contractors, agents, licensors, vendors, service providers, and partners from and against any claims, liabilities, damages, judgments, awards, losses, demands, penalties, costs, expenses, or fees (including reasonable attorneys’ fees and legal costs) arising out of or related to:

Your violation of these Terms of Use or any applicable laws or regulations

Your use, misuse, or abuse of the Macabre.rip marketplace, services, auctions, or platform

Any products, listings, bids, transactions, communications, or content you submit, upload, post, sell, purchase, transmit, or distribute through the marketplace

Your violation of any third-party rights, including intellectual property, copyright, trademark, publicity, privacy, or contractual rights

Any dispute, charge back, claim, refund request, shipment issue, product issue, or transaction dispute between you and another user, buyer, seller, vendor, artist, collector, or auction participant platform

Any fraudulent, unlawful, deceptive, abusive, or negligent activity conducted through your account or by you in connection with the marketplace

Governing Law & Disputes

These Terms and any dispute, claim, or controversy arising out of or relating to Macabre.rip, the marketplace, auctions, services, or your use of the platform shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

You agree that any legal action, claim, or proceeding arising from or relating to these Terms or the use of Macabre.rip shall be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction and venue of such courts.

Informal Resolution

Before initiating any formal legal action, you agree to first contact us in writing and provide a detailed description of the dispute, claim, or concern. Both parties agree to make a good-faith effort to resolve the matter informally within thirty (30) days before pursuing litigation or other formal proceedings.

Waiver of Jury Trial

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND MACABRE LLC EACH KNOWINGLY, VOLUNTARILY, AND IRREVOCABLY WAIVE THE RIGHT TO A TRIAL BY JURY IN ANY LEGAL ACTION, CLAIM, OR PROCEEDING ARISING OUT OF OR RELATED TO THESE TERMS, THE MARKETPLACE, OR THE USE OF MACABRE.RIP.

Changes to These Terms

We reserve the right to modify, revise, or update these Terms of Use at any time at our sole discretion. When changes are made, we will update the “Last Updated” date displayed on this page. For material changes that significantly affect your rights or obligations, we may provide additional notice through the marketplace, by email to registered users, or through other reasonable means prior to the changes taking effect.

Your continued access to or use of Macabre.rip following the effective date of any updated Terms constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue use of the marketplace and related services immediately.

We encourage all users, vendors, buyers, sellers, and auction participants to review these Terms periodically to remain informed of their current rights and responsibilities. The most current version of these Terms will always be available through Macabre.rip.
